Terms and Conditions
1. Agreement
These Terms and Conditions govern your use of the website, application and services operated by شركة خامي الكويت وكيل بالعمولة والتجارة بالعمولة under the name Khami ("Khami", "we", "us"). By accessing or using Khami, you agree to these Terms. If you do not agree, do not use the platform.
You must be at least 18 years old and legally able to enter into a binding contract to use Khami. If you use Khami on behalf of a business, you confirm you are authorised to bind that business to these Terms.
2. Khami's role
Khami is a digital marketplace. Khami is not a fabric manufacturer, a clothing manufacturer, a tailor, or a delivery company.
Khami provides a platform on which independent fabric stores list and sell fabric; independent tailors offer tailoring services; customers select a fabric, select a tailor, and place an order; delivery providers move fabric and finished garments; and an authorised payment service provider processes payments.
Fabric stores, tailors, delivery providers and payment service providers are independent third parties. They are not employees, agents, partners in the legal sense, or subsidiaries of Khami. Khami does not own, control or supervise their businesses.
When you buy fabric, you buy it from the fabric store. When you commission tailoring, you commission it from the tailor. Khami facilitates and coordinates these transactions and provides the platform on which they take place.
Khami does not manufacture, inspect before dispatch, or warrant the quality of any fabric or garment supplied through the platform, and does not carry out or supervise tailoring work.
3. Accounts
To place an order you must create an account and provide accurate, current and complete information.
You are responsible for keeping your account credentials confidential, and for all activity under your account. Tell us immediately at support@khamikuwait.com if you believe your account has been accessed without your permission.
One person may hold one account. Accounts may not be sold, shared or transferred.
4. Customer responsibilities
As a customer you agree to:
- provide accurate account, contact and delivery information, and keep it current;
- provide accurate measurements. Measurements are the basis on which your garment is made. Khami does not take, verify or check your measurements, and is not responsible for a garment that does not fit because the measurements provided were inaccurate, out of date, or measured incorrectly;
- review your order carefully — fabric, quantity, tailor, garment type, tailoring options, measurements and delivery address — before confirming it;
- be available, or make someone available, to receive delivery at the address and contact number provided;
- pay the full amount due for your order;
- use the platform lawfully, and not to place fraudulent orders, misuse the service, or infringe anyone's rights.
5. Fabric store responsibilities
Fabric stores participating on Khami are responsible for:
- describing their fabrics accurately, including composition, width, colour and price;
- keeping listings and stock availability current;
- supplying fabric that matches its description and is of satisfactory quality;
- preparing fabric and making it available for collection within the agreed timeframe;
- holding valid commercial registration and any licences required for their activity in Kuwait;
- complying with applicable Kuwaiti law, including consumer protection law;
- cooperating in resolving customer issues relating to fabric they supplied.
The fabric store, not Khami, is responsible for the fabric it supplies.
6. Tailor responsibilities
Tailors participating on Khami are responsible for:
- describing their services, garment types, options and prices accurately;
- making garments in accordance with the confirmed order details and measurements;
- exercising reasonable skill and care;
- completing work within the agreed timeframe;
- handling customer fabric carefully while it is in their possession;
- keeping customer measurements confidential and using them only to complete the order;
- holding valid commercial registration and any licences required for their activity in Kuwait;
- complying with applicable Kuwaiti law;
- cooperating in resolving customer issues relating to work they carried out.
The tailor, not Khami, is responsible for the tailoring work carried out.
Khami does not guarantee or directly provide new customers to tailors. Customers independently choose their preferred participating tailor.
7. Orders, pricing and payment
Prices. Fabric prices are set by fabric stores. Tailoring prices are set by tailors. Prices are shown in Kuwaiti Dinar (KWD).
Order total. Your total may include the fabric price, the tailoring price, and delivery charges. The total is shown before you confirm.
Order confirmation. Your order is an offer to purchase. It is accepted when we confirm it to you. We may decline an order where the fabric is unavailable, the tailor is unable to take the work, we suspect fraud, or there has been a pricing or listing error.
Errors. If an order is affected by an obvious pricing or description error, we may cancel it and refund you in full. We will contact you if this happens.
Payment. Payment is taken at the time set out at checkout, through MyFatoorah, an authorised third-party payment service provider. Khami does not store full payment card details. Your payment is also subject to MyFatoorah's own terms.
Failed payment. Orders with failed or reversed payments may be cancelled.
8. Delivery
Khami arranges delivery of purchased fabric to the tailor you selected, and delivery of the completed garment to you. Delivery is available across all governorates of Kuwait.
Delivery timeframes are estimates. They depend on fabric availability, the tailor's workload and schedule, and delivery conditions. Estimates are not guarantees and are not contractual commitments.
You are responsible for the accuracy of the delivery address and contact number. Failed deliveries caused by an incorrect address, an unavailable recipient, or refused delivery may incur a re-delivery charge and may delay your order.
Risk in the goods passes to you on delivery.
9. Measurements and fitting
You are responsible for the accuracy of the measurements you provide or select for an order. Saved measurements are used as they appear on your account at the time you confirm the order — review them before each order.
Khami does not take measurements, verify them, or advise on how to measure. Any measuring guidance published on the platform is general information only.
Whether a tailor offers fittings or alterations, and on what terms, is decided by that tailor and varies. Any fitting or alteration arrangement is between you and the tailor.
A garment made correctly to the measurements you confirmed is not defective because the measurements were wrong. Remedies in that situation, if any, are at the discretion of the tailor.
10. Cancellations and refunds
Cancellation and refund rights are set out in full in our Refund and Cancellation Policy, which forms part of these Terms.
In summary: cancellation is possible only until the fabric store begins cutting the fabric. Because stores may begin immediately after an order is confirmed, no cancellation window is guaranteed. Once fabric has been cut, or work on a made-to-measure garment has started, cancellation and refund options are limited, because the goods cannot be resold. Defective, damaged or incorrect orders are handled separately under that policy.
Nothing in these Terms removes any right you have under the applicable consumer protection law of the State of Kuwait.
11. Quality disputes
If you are not satisfied with fabric or tailoring received through Khami, contact support@khamikuwait.com with your order number and photographs where relevant, within 14 days of receiving your order.
Khami will review the complaint and act as a point of coordination with the fabric store or tailor concerned, and will use reasonable efforts to help reach an outcome.
Khami's role in a dispute is to coordinate and, where our policies provide for it, to apply a remedy. Khami is not a judge of workmanship and is not liable for the quality of goods supplied or work carried out by independent third parties. Legal responsibility for the fabric rests with the fabric store, and for the tailoring with the tailor.
If a dispute cannot be resolved, you retain any rights you have under Kuwaiti law, including the right to raise the matter with the competent authorities.
12. Intellectual property
The Khami name, the Arabic name خامي, the Khami logo, the design of the website and application, and the text, layout, graphics and software that make up the platform are owned by شركة خامي الكويت وكيل بالعمولة والتجارة بالعمولة or licensed to it, and are protected by applicable intellectual property law.
You may not copy, reproduce, modify, distribute, republish or create derivative works from any part of the platform without our prior written permission. You may not use the Khami name or logo without permission.
Content supplied by fabric stores and tailors — including product images and descriptions — remains the property of those businesses, who grant Khami the right to display it on the platform.

13. Prohibited use
You may not:
- use Khami for any unlawful purpose or in breach of Kuwaiti law;
- provide false, misleading or fraudulent information;
- impersonate another person or business;
- attempt to gain unauthorised access to the platform, its systems or another user's account;
- interfere with or disrupt the platform, or introduce malicious code;
- extract, scrape or copy platform data by automated means without permission;
- resell or commercially exploit the platform or its content without permission;
- harass, abuse or threaten other users, participating businesses, or our staff.
14. Account suspension and termination
We may suspend or terminate your account, or restrict access to the platform, where we reasonably believe you have breached these Terms, provided false information, engaged in fraudulent or unlawful activity, or misused the platform — and where we are required to do so by law.
Where practical and lawful, we will tell you the reason and give you an opportunity to respond.
You may close your account at any time by contacting support@khamikuwait.com. Closing your account does not affect orders in progress, amounts owed, or records we are required to keep.
Sections that by their nature should survive termination — including intellectual property, limitation of liability, and governing law — continue to apply.
15. Limitation of liability
To the maximum extent permitted by the law of the State of Kuwait:
- The platform is provided on an "as is" and "as available" basis. We do not warrant that it will be uninterrupted, error-free, or free of defects.
- Khami is not liable for the quality, safety, legality, fitness for purpose or accuracy of description of fabric supplied by fabric stores or tailoring carried out by tailors.
- Khami is not liable for the acts or omissions of fabric stores, tailors, delivery providers or payment service providers, who are independent third parties.
- Khami is not liable for a garment that does not fit because of measurements provided by the customer.
- Khami is not liable for indirect, incidental, special or consequential loss, or for loss of profit, revenue, data or opportunity.
- Where Khami is found liable, our total liability in connection with an order is limited to the total amount paid by the customer for that order.
Nothing in this section excludes or limits liability that cannot be excluded or limited under the law of the State of Kuwait, including any liability for fraud, or for death or personal injury caused by negligence.
16. Indemnity
You agree to indemnify شركة خامي الكويت وكيل بالعمولة والتجارة بالعمولة against claims, losses and reasonable costs arising from your breach of these Terms, your misuse of the platform, or your infringement of the rights of a third party.
17. Third-party services
The platform relies on third-party services including MyFatoorah, delivery providers, hosting providers and app store platforms. Your use of those services may be subject to their own terms and privacy policies. Khami is not responsible for their performance or availability.
18. Force majeure
Khami is not liable for failure or delay in performance caused by events outside our reasonable control, including natural events, fire, flood, epidemic, war, civil unrest, strikes, failure of utilities or telecommunications, government action, or the failure of third-party providers.
19. Changes to these Terms
We may update these Terms. The "Last updated" date will change, and where the change is significant we will give notice through the platform or by email. Continuing to use Khami after a change means you accept the updated Terms. The version in force at the time you place an order applies to that order.
20. Governing law and jurisdiction
These Terms, and any dispute or claim arising out of or in connection with them, are governed by the laws of the State of Kuwait.
The courts of the State of Kuwait have exclusive jurisdiction over any dispute arising out of or in connection with these Terms.
21. General
Severability. If any provision is found invalid or unenforceable, the remaining provisions continue in force.
No waiver. A failure to enforce any provision is not a waiver of the right to enforce it later.
Entire agreement. These Terms, together with the Privacy Policy, Refund and Cancellation Policy and Cookie Policy, form the entire agreement between you and Khami regarding the platform.
Assignment. You may not assign your rights under these Terms. We may assign ours as part of a business transfer.
Language. These Terms are published in Arabic and English. In the event of any discrepancy between the two versions, the Arabic version prevails.
